The criminal justice system is complicated, especially when it comes to drunk driving. When you are arrested for DUI in California, you will be prosecuted by two different agencies: the City Attorney or District Attorney and the Department of Motor Vehicles. Each of them will handle your case differently.

The consequences of a DUI conviction can be severe. If this is your first offense, the minimum sentence is three years of probation on the condition that you:

• Pay a $390 fine, plus penalties and fees. The penalty assessment is 200%. Depending on the jurisdiction, your fine could total $1,200 to $1,500.
• Have a restriction on your drivers' license for 90 days, or spend (a minimum of) 48 hours in jail (not all jurisdictions allow a restricted license instead of mandatory jail time, and you could get as much as 6 months in jail for a first offense).
• Attend an alcohol education program once a week for 90 days.

While jail time is not usual for a first offense, no one can promise you anything without knowing the facts of your case. Some California courts will require formal probation; others will require summary probation (without a probation officer).
